No Reserve/Absolute Auctions

The item WILL be sold on the auction end date to the highest bidder regardless of price. This is the most aggressive option and typically brings the highest return in the fastest way possible. There is some risk with this option. If you cannot tolerate risk DO NOT select this option. Average turnaround time 4 weeks.

Reserve Auctions

The item will be sold on the auction end date so long as the “Reserve” price has been met. If the “Reserve” price is not met, you will still incur fees as if the “Reserve” price was the sale amount. Average turnaround time 4 weeks.

The item will be sold in the “Retail Marketplace”. This selection can bring a decent return, but it can take considerably more time.

CONSIGNOR AGREEMENT

Consignor Agreement: Consignor grants Bidz Buzz, LLC the Exclusive Right to sell said property for the term of this agreement, 180 days for the “Retail Consignment” option or for the auction date specified for the AuctionTime.com auction option, and agrees to pay Bidz Buzz, LLC, for services rendered by Bidz Buzz, LLC, a commission set forth above in the “Fees” section. Bidz Buzz will sell the items under the “Retail Consignment” method by posting them on various advertising sites of Bidz Buzz’s choice. If the consignor selects a “No Reserve” or “Reserve” auction, the venue will be AuctionTime.com’s auction on a sale date selected by the consignor.

All items are accurately and completely described. Any mechanical issues were revealed and are identified in the “Item” info section above for each item consigned. If the condition of the item changes prior to the sale date, consignor must inform Bidz Buzz, LLC to avoid any misrepresentation to interested buyers. Unless otherwise specified, all odometer and hour meter readings are correct.

The undersigned is the legal owner of this/these item(s) or has the legal authority to authorize the items sale and release. Once an item is consigned to a stated auction it may not be removed from the auction and must be released to any winning bidder so long as the reserve price, if one has been set, has been met. If reserve price for an item is established, it is listed in this agreement and consignor agrees that item will be released if it is met by the winning bidder or, if no Reserve is selected, consignor agrees to release the item to the winning bidder regardless of the winning bid amount.

After the Auction: Once items have been paid for, consignor will receive a Post Auction Summary form to verify the selling price of each Lot. As a general rule this is done six (6) banking days after the auction date to allow for collection and processing of buyer’s payments. For buyers that wish to arrange pickup sooner than 6 banking days, funds will be paid out as they are received to authorize the release of said item(s). Any late payments received from buyers will be processed and paid upon receipt.

Consignor Buy Back/Shill Bids: Buy Backs/Shill bids are against the rules of the auction. If the Consignor or associate of the Consignor bids on, and is the winning bidder on an item which is subject to this consignment, Consignor agrees to pay Bidz Buzz, LLC an amount of 8% on items up to $14,999 and 6% for items $15,000 up to $99,999, and 4% for items $100,00 and above.

Terms: Consigned items will stay at the consignor’s location until the conclusion of the sale. Once consignor has been paid, consignor agrees to release item(s) to the buyer and as much is reasonable, to assist with loading the item(s). If disassembly or additional equipment such as a crane is needed to load a consigned item, it will be the buyer’s responsibility to provide such additional personnel or equipment.

Bidz Buzz, LLC agrees to advertise the sale of consigned items and promote attendance of buyers. Consignor agrees to pay all expenses of starting, handling and making units ready for sale. If an item(s) is advertised as running or operational, the item must be running or operational prior to pickup by the buyer.

Titled Units: Consignor represents to Bidz Buzz, LLC that no vehicle covered by this agreement has a Rebuilt, Salvage or Reconstructed Title unless specified. Original titles must be provided to Bidz Buzz and must be in the consignor’s name, be accompanied by a Bill of Sale signed by consignor, a completed signed (Notarized if required) Power of Attorney or signed off title, a copy of the consignor’s drivers license, bank wire info to pay the consignor, and the completely fill out and signed Consignment Agreement. Upon sale of the titled item, the consignor will be paid via wire transfer and the title will be sent via Fedex to the Buyer.

No Sale Clause: Consignor agrees he will not sell or cause to be sold, any of the property subject to this consignment and if this occurs, consignor agrees to pay 15% of the Reserve Price, or Auction Average, as determined by the Sandhills Fleet Evaluator tool, If no Reserve Price is elected, as a penalty fee which will be due and payable within 2 business days of demand. If for any reason, a winning bidder fails to pay, the consignor has the option to include the item(s) in the next auction, have item(s) brokered by Bidz Buzz, LLC, or to keep the item and no fees are due by either party. If a bidder requests to view the item(s), the consignor agrees to make the item(s) available for inspection and agrees to refuse any, and all, offers a bidder may make in person and will direct the bidder to bid on the item in the above specified auction. For any sold item, if Consignor fails to release the item, Consignor agrees to pay a contract default fee of 25% of the Winning Bid, so long as the reserve price (if a reserve price was selected) was met, for an item with no reserve established, the unit must be released without regard to the final bid price. If the item is not released, the consignor is in default and must pay Bidz Buzz a fee of 25% of the winning bid, If payment is not received within 2 days of demand, Bidz Buzz reserves the right to pursue legal remedies. The consignor agrees that the legal jurisdiction shall be in Volusia County, Florida. The consignor further agrees that the prevailing party will be entitled to collect attorney/legal fees. Items with a reserve price that do not receive a bid high enough to meet the reserve will be charged an amount of 8% on items up to $14,999 and 6% for items $15,000 to $99,999, and 4% for items above $100,000 for services rendered.

Liens: Consignor agrees to promptly furnish copies of all documents reflecting existing liens or security interests in said property and authorizes Bidz Buzz, LLC to pay any such liens or security interests out of sales proceeds remaining after payment of Bidz Buzz, LLC’s expenses and commissions. If the proposed sale constitutes a “bulk transfer”, the Consignor agrees to timely furnish to Bidz Buzz, LLC, all information required by law. The Consignor agrees to deliver the title for said property to the purchaser by appropriate documents, free and clear of all encumbrances. Bidz Buzz, LLC agrees, unless delayed by legal proceedings or inability of Bidz Buzz, LLC, through no fault of its own, to transfer title or to comply with the Uniform Commercial Code or other laws, to make settlement with Consignor on or before six (6) banking days following date of auction sale for all funds received. Payments to consignor are made by check or bank wire ($20.00 wire fee will be withheld for each wire payment). Consignor agrees to indemnify and hold Bidz Buzz, LLC harmless from all liabilities, loss and expense arising out of any claim for loss or damage to said unit, personal injury or property damage and/or consequential damages, breach of warranty, misrepresentation, or defect in title related to the sale of said property. Should any portion of this agreement need to be enforced by a Court of Law, Volusia County, Florida shall be the designated jurisdiction for such action.

Removals: Once an item is listed online, if the Consignor removes the item, there will be a $995 removal fee. Once a bid is received the item cannot be removed.
